The Site is operated by TrueNorth Marketing, doing business as TrueNorth Merchant Advisory (“TrueNorth,” “we,” “us”), based in Oklahoma City, Oklahoma. By using the Site, you agree to both.

Part 1 – Terms and Conditions

1. Our role

TrueNorth provides consulting, sales and referral services related to merchant processing, point-of-sale (POS) systems and POS support. We are not a bank, payment processor or money transmitter. TrueNorth is affiliated with Keavara, an independent sales organization. Merchant accounts are approved and provided by third-party payment processors and their sponsor banks, and POS hardware and software are provided by third-party manufacturers. Any service you obtain is governed by the separate agreement you sign with that provider, and we may be compensated by those providers.

2. Information only; no guarantees

Content on the Site is general information, not legal, tax, accounting or financial advice. Savings estimates and proposals are based on the information you provide and current market pricing and are not a guarantee of future costs or results. Final rates, fees and approval are set by the processor or provider.

3. Use of the Site

You may use the Site for lawful business purposes only. You agree not to submit false information, attempt unauthorized access, upload harmful code, scrape the Site, or use it in violation of any law.

4. Intellectual property and third parties

Site content is owned by or licensed to TrueNorth. Third-party names and trademarks belong to their owners. We are not responsible for third-party websites or services linked from the Site.

5. Disclaimers and limitation of liability

The Site is provided “as is” without warranties of any kind. To the fullest extent permitted by law, TrueNorth will not be liable for indirect, incidental or consequential damages arising from your use of the Site, and our total liability for any Site-related claim will not exceed $100.

6. Governing law and changes

These Terms are governed by the laws of the State of Oklahoma, with venue in Oklahoma County. We may update these Terms by posting a revised version with a new effective date.

7. Email and SMS program terms

Email. If you submit your email address, you agree to receive emails about your inquiry, account or services.

SMS / text messaging. TrueNorth Marketing Alerts is a text messaging program operated by TrueNorth Marketing (TrueNorth Merchant Advisory). By checking the optional SMS consent box on our forms, replying YES to our SMS consent email, or texting us to opt in, you agree to receive text messages from TrueNorth at the mobile number you provided about your inquiry, appointments, account and service notifications, and customer support. We do not send promotional or marketing text messages.

• Message frequency may vary.
• Message and data rates may apply.
• Reply STOP to any message to opt out. You will receive one confirmation and no further messages unless you opt in again.

• Carriers are not liable for delayed or undelivered messages.

Part 2 – Privacy Policy

1. Information we collect

Information you give us through forms (name, business name, email, phone, message), processing statements and documents you choose to share, and application details required by a processor or provider. Our website platform may also collect technical data such as IP address, browser and pages visited through cookies and similar tools.

2. How we use it

To respond to your inquiry, prepare statement reviews and proposals, help you apply for and set up services you request, provide support, operate and secure the Site, and meet legal obligations.

3. How we share it

We do not sell your personal information. We share it only with processors, banks and vendors when you ask us to set up a service, with service providers that help us run our business, for legal reasons, or in a business transfer.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are excluded from all of the sharing categories above and will not be shared with any third parties, except the messaging providers that deliver our texts on our behalf.

4. Text messages

If you opt in, we use your mobile number only for the messages described in Section 7 of our Terms, and we keep a record of your consent. Reply STOP to opt out or HELP for help at any time. Message and data rates may apply, and message frequency may vary.

5. Statements and sensitive data

Statements and application documents are used only to evaluate and provide the services you request. Please don’t send full card numbers, bank passwords or Social Security numbers by regular email.

6. Security, retention and your choices

We use reasonable safeguards to protect your information, keep it only as long as needed, and will honor requests to access, correct or delete your information as required by law. The Site is intended for businesses and is not directed to children under 13.
